Manage incomplete and missing criminal record disclosures

In Canada, standard criminal records checks rely on applicants disclosing their own criminal history. In some cases, applicants may fail to disclose their record or disclose it inaccurately, leading to a “Not Clear - Incomplete” result. No further details are provided due to RCMP policy, which poses a challenge for hiring managers seeking to understand their candidates’ criminal history. In these cases, a criminal record background re-check can give applicants another chance to provide a disclosure and bring more trust to organizations.

How does Sterling Backcheck’s criminal record re-check work?

Step 1: Inform the candidate that you would like them to consent to a second criminal record re-check based on a new, complete disclosure of their criminal record. Invite them to fill out the forms using our online Candidate Hub.

Step 2: The candidate logs in and provides complete details about their criminal history securely online.

Step 3: Sterling Backcheck forwards the revised consent and disclosure forms to our police partners to conduct a second query on the candidate. A result of “Not Clear - Confirmed” will be returned if the declaration is now accurate. You will be able to review the complete disclosure and make an informed hiring decision.

Not Clear - Incomplete
If the candidate has not provided an accurate or complete disclosure of their criminal history, the check will once again return a “Not Clear - Incomplete” result. You will need to order another criminal background re-check or send the candidate for fingerprints.

When should employers order a criminal record re-check?

A criminal record re-check should be requested if a standard Canadian Criminal Record Check, ordered within the last 30 days, returns a “Not Clear - Incomplete” result, indicating the applicant has not accurately disclosed their criminal record. This service is a faster and more cost-effective alternative to the standard criminal check. Background checks are not considered complete until all applicants’ criminal convictions have been verified.

How long does the criminal record re-check take?

The criminal record re-check process for candidates is less time-consuming than the standard check, as it bypasses the need for identity verification. Once all required information is submitted, the criminal record background re-check is completed in under four hours.
